These Terms of Service ("Terms") govern your use of Opencard, operated by Freshar Technology Limited. By accessing or using the site, you agree to these Terms. If you do not agree, do not use the site.

The service

Opencard provides Pokemon Trading Card Game market data, price comparisons, rankings, and related tools for informational purposes. Prices and population data come from third-party sources and may be delayed, incomplete, or inaccurate. Nothing on the site is financial, investment, or collecting advice.

Accounts

Some features require signing in. You are responsible for activity under your account and for keeping access credentials secure. You must provide accurate information and be old enough to form a binding contract in your jurisdiction (and at least 13 years old).

Acceptable use

You agree not to:

• Scrape, overload, or disrupt the site or its APIs beyond ordinary use
• Attempt unauthorized access to systems, accounts, or data
• Use the site to violate law, infringe IP, or harm others
• Misrepresent affiliation with Opencard or Google
• Click ads fraudulently or encourage others to click ads
• Republish substantial site data without permission

Intellectual property

Site software, branding, and original content belong to Freshar Technology Limited or its licensors. Pokemon, card names, images, and related marks belong to their respective owners (including Nintendo / Creatures / Game Freak / The Pokemon Company and card artists). We do not claim ownership of third-party trademarks or card artwork.

Third-party links & ads

The site may link to marketplaces and show third-party advertisements (including Google AdSense). We are not responsible for third-party sites, products, or practices. Your dealings with advertisers are solely between you and them.

Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that prices are accurate or that the service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, Freshar Technology Limited and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the site. Our total liability for any claim relating to the service will not exceed the greater of (a) amounts you paid us in the 12 months before the claim, or (b) USD $50.

Indemnity

You agree to indemnify and hold harmless Freshar Technology Limited from claims arising out of your misuse of the service or violation of these Terms.

Termination

We may suspend or terminate access at any time if you violate these Terms or if we discontinue the service. Provisions that should survive (including disclaimer, limitation of liability, and indemnity) will survive termination.

Changes

We may update these Terms by posting a revised version with a new "Last updated" date. Continued use after changes constitutes acceptance.
